Public Hearings and Common Council Meeting

At 6:30 PM a Public Hearing was conducted for Local Law 1 for 2016 entitled: A LOCAL LAW AUTHORIZING A PROPERTY TAX LEVY IN EXCESS OF THE LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW §3-C
 
Mayor Morse, “All though the City of Cohoes is proposing a 0% increase in property tax as well as a 0% increase in water and sewer, based on the fact that our levy has grown and our City has grown above and beyond what we are entitled to under the property tax cap law, we are required to over ride the property tax cap in the City of Cohoes.  I underscore the proposed budget is a 0% property increase and a 0% water – sewer increase.”
 
Public Comment:
 
Unknown speaker, “So there is no actual increase in taxes?  Is the library part of the City Budget?”
 
Mayor Morse, “Correct, there will be no tax increase.  Yes, the library is under the City Budget, and their budget has been increased by 4%.”
 
At 6:35 PM, with no further public comments, Council Member Russell made a MOTION to close the public hearing.  Seconded by Council Member Smith.  All members voted “AYE”.  The public hearing was adjourned.
 
At 6:45 PM a Public Hearing was conducted for the adoption and approval of the annual estimate for fiscal year 2017.
 
Mayor Morse, “We will have a 0% increase in property taxes and a 0% increase in the water/sewer rates.”
 
Josh, “How does a 0% increase affect the tax rate”?
 
Mayor Morse, “There is no cost to the taxpayer”.
 
Council Member McCarthy, “At one time, the City took loans to cover the last month of the year, correct?”
 
Michael Durocher, “Yes, the last one was in 1999.”
 
At 6:50, with no further public comments, Council Member Russell made a MOTION to close the public hearing.  Seconded by Council Member Smith.  All members voted “AYE”.  The public hearing was adjourned.

At 7:00 PM, the Common Council Meeting was called to order.
 
Council Member Russell made a MOTION to approve the minutes from the September 27 and October 11, 2016 meetings.  Council Member McCarthy seconded the motion.  All members voted “AYE”.  The motion passed.
 
Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka introduced Resolution No. 68 for 2016
 
A RESOLUTION DESIGNATING OCTOBER 2016 AS BULLYING AWARNESS MONTH
 
Council Member Russell made a motion to approve Resolution No. 68 for 2016, seconded by Council Member Napier.  A roll call vote was taken, Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka voted “AYE”.  Resolution No. 68 for 2016 passed.

A RESOLUTION AUTHORIZING THE IMPLEMENTATION AND FUNDING IN THE FIRST INSTANCE OF 100% OF THE FEDERAL-AID AND STATE “MARCHISELLI” PROGRAM-AID ELIGIBLE COSTS OF A TRANSPORTATION FEDERAL-AID PROJECT AND APPROPRIATING FUNDS THEREFOR
 
Council Member Koniowka made a motion to approve Resolution No. 69 for 2016, seconded by Council President Briggs.  A roll call vote was taken, Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka voted “AYE”.  Resolution No. 69 for 2016 passed.

A RESOLUTION AUTHORIZING THE CITY TO ENTER INTO AN AGREEMENT WITH NYSERDA TO UPGRADE THE CITY COMPREHENSIVE PLAN, CGC42156/CONTRACT 57243
 
Council Member Russell made a motion to approve Resolution No. 70 for 2016, seconded by Council President Briggs.  A roll call vote was taken, Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka voted “AYE”.  Resolution No. 70 for 2016 passed. 
 
Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka introduced Resolution No. 71 for 2016
 
A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE COHOES HOUSING AUTHORITY AND THE CITY OF COHOES FOR CODE ENFORCEMENT SERVICES
 
Council Member Russell made a motion to approve Resolution No. 71 for 2016, seconded by Council Member Napier.  A roll call vote was taken, Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka voted “AYE”.  Resolution No. 71 for 2016 passed. 
 
Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka introduced Resolution No. 72 for 2016
 
A RESOLUTION AMENDING THE ANNUAL BUDGET FOR FISCAL YEAR 2016
 
Council Member Russell made a motion to approve Resolution No. 72 for 2016, seconded by Council Member Smith.  A roll call vote was taken, Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka voted “AYE”.  Resolution No. 72 for 2016 passed.  A copy of budget transfers are attached.

AN ORDINANCE ACCEPTING AN EASEMENT FROM COHOES-LION HEART HOUSING DEVELOMENT FUND COMPANY, INC. FOR REPAIR AND MAINTENANCE OF A WATERLINE
 
Council Member Russell made a motion to approve Ordinance No. 8 for 2016, seconded by Council President Briggs.  A roll call vote was taken, Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka voted “AYE”.  Ordinance No. 8 for 2016 passed

AN ORDINANCE ACCEPTING AN EASEMENT FROM JOSEPH MUSCATELLO
 
Council Member Napier made a motion to approve Ordinance No. 9 for 2016, seconded by Council Member Russell.  A roll call vote was taken, Council President Briggs, and Council Members Smith, Russell, McCarthy, Napier, and Koniowka voted “AYE”.  Ordinance No. 9 for 2016 passed
 
 
 
 
 
PUBLIC COMMENT:
 
Rich Thompkins, “Regarding the NYSERDA agreement. NYSERDA is an organization that distributes money from the state for energy programs.  I don’t understand the relationship with the Comprehensive Plan.”
 
Mayor Morse, “NYSERDA has funds available that fit into the Comprehensive Plan, part of which is energy related as well as a host of other things that the community wanted.”
 
Mayor Morse announced that a Special Common Council Meeting will be held on Thursday, October 27, 2016 at 7:00 PM to approve the 2017 Budget.
 
At 7:10 PM, Council Member Russell made a MOTION to adjourn, seconded by Council Member Napier.  The Common Council Meeting was adjourned.
