Council Member Nolin made a MOTION to approve the minutes of the July 27 and August 24, 2010 Common Council Meetings. Council Member Ceccucci seconded the motion, all members voted “AYE”. The motion passed
 
At 7:01 PM, a Public Hearing was conducted regarding Local Law 4-I entitled: A LOCAL LAW TO AMEND THE CODE OF ETHICS
 
Mayor McDonald, “As many members of the public realize, the Common Council, collectively, has spent a significant amount of time over the past four-five months updating our Code of Ethics. There are many features within this amended chapter that has not been updated since 1970. The Council had thought it a good idea to have a public comment period for the past 45 days.”
 
George Hebert, 40 Masten Ave., “Some years ago a City Official took city records home; the records were lost in a fire. Those records should have never left the building. I asked for this person to be prosecuted for that incident. This sort of action is a serious detrimental blow to the community. It is a willful intent to cover wrongful deeds from the taxpayer of the city. I am hoping this change covers it from happening again.”
 
Mayor McDonald, “We have a process in place to review if it ever happens, but you raise a valid point. Not many employees take documents home, and they only take them with permission by the department head or myself.”
 
At 7:08 PM, with no further public comment being made, Council Member Kennedy made a MOTION to close the Public Hearing, Council Member Signoracci seconded the motion, all members voted “AYE”. The motion passed.

A LOCAL LAW TO AMEND THE CODE OF ETHICS
 
A roll call vote was taken, Council President Primeau, and Council Members Kennedy, Turcotte, Nolin, Ceccucci, and Signoracci voted “AYE”. Local Law No. 4-I for 2010 passed.

AN ORDINANCE AUTHORIZING NOT TO EXCEED $990,000 AGGREGATE PRINCIPAL AMOUNT OF SHORT-TERM BOND ANTICIPATION NOTES (BAN), TO FINANCE CONSTRUCTION OF BRIDGE AVENUE BRIDGE AT AN ESTIMATED MAXIMUM COST NOT TO EXCEED $990,000, TERMS OF BOND ANTICIPATION NOTES (BAN), ARE SEPTEMBER 29 2010, THROUGH DECEMBER 31, 2010

A RESOLUTION APPROVING A CONTRACT FOR PROFESSIONAL SERVICES
 
Mayor McDonald, “As discussed at the Council last month, this would award a contract to Malcolm Pirnie for $150,000.00 to commence with engineering services, final design, and bidding, bidding contract review and also construction inspection for the stormwater/sewer separation project that we received a grant from the State for”.
 
A roll call vote was taken, Council President Primeau, and Council Members Kennedy, Turcotte, Nolin, Ceccucci, and Signoracci voted “AYE”. Resolution No. 39 for 2010 passed.

A RESOLUTION APPROVING COMPROMISE AND SETTLEMENT OF PENDING LITIGATION BY THE CORPORATION COUNSEL
 
Mayor McDonald, “As discussed in Executive Session last month, the City had a claim filed by John Scheemaker against the Police Department. Counsel appointed by NYMIR had worked with their Counsel and it was recommended that the City settle for our deductable of $5,000.00”.
 
A roll call vote was taken, Council President Primeau, and Council Members Kennedy, Turcotte, Nolin, Ceccucci, and Signoracci voted “AYE”. Resolution No. 40 for 2010 passed.

PUBLIC COMMENTS
 
George Hebert, 40 Masten Ave., “I was reading the article on Mr. Silliman this week, which was impressive, I did not realize he did so much for our community. It is a shame the Historical Society does not have a tribute to Mr. Silliman. It would be nice to have pictures and bios for people to see”.
 
John, 16 McElwain Ave., “About three weeks ago, while walking dogs on leash on the bike path, a bike racer hit my dog. Something needs to be done. The racers go by so fast, they do not have any respect for the residents and walkers, they come very close to you. What can residents do?”
 
Mayor McDonald, “One good point is that people are using the bike path. Maybe we need to educate people better. County is responsible for the maintenance of the bike path, while the City is responsible for the patrol.”
 
At 7:45 PM, with no further business to come before the Council, Council Member Signoracci made a MOTION to adjourn, seconded by Council Member Ceccucci. The motion passed.
